These Terms of Service ("Terms") govern your access to and use of Waunch, an all-in-one platform for creating, marketing and selling courses, memberships and digital products ("Service"). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of terms
By accessing or using Waunch, you confirm that you are at least 18 years old, or the age of legal majority in your jurisdiction, and that you have the authority to enter into this agreement, whether on your own behalf or on behalf of an organization.
2. Description of service
Waunch provides tools for hosting courses and memberships, building marketing funnels, sending email, processing checkout and payments, and running community spaces. Features available to you depend on your subscription plan and may change over time as we improve the Service.
3. Accounts
- You are responsible for maintaining the confidentiality of your account credentials.
- You must provide accurate and complete information when creating your account.
- You are responsible for all activity that occurs under your account.
- Notify us immediately of any unauthorized use of your account.
4. Subscriptions and billing
Paid plans are billed in advance on a recurring basis, monthly or annually depending on your selection. Subscriptions renew automatically unless canceled before the renewal date. You authorize us to charge your chosen payment method for all applicable fees, including taxes.
Fee changes will be communicated in advance and will apply from your next billing cycle. Refunds are handled under our separate Refund Policy.
5. Acceptable use
You agree not to use Waunch to:
- Sell or promote illegal products, services, or content that infringes another party's rights.
- Distribute malware, spam, or engage in deceptive marketing practices.
- Attempt to gain unauthorized access to the Service or other users' accounts or data.
- Violate any applicable law or regulation, including consumer protection and data protection laws.
We may suspend or remove content or accounts that violate this section.
6. Your content
You retain ownership of the courses, media, and other content you upload to Waunch ("Your Content"). By uploading Your Content, you grant us a limited license to host, store, and display it as necessary to operate the Service and deliver it to your students or customers. You are solely responsible for Your Content and for ensuring you have the rights to use and sell it.
7. Intellectual property
The Waunch platform, including its software, design, and branding, is owned by us or our licensors and is protected by intellectual property laws. Nothing in these Terms grants you rights to our trademarks or brand assets except as needed to reasonably reference the Service.
8. Termination
You may cancel your account at any time from your account settings. We may suspend or terminate your access if you materially breach these Terms, including violations of the Acceptable Use section, or if required by law. Upon termination, your right to access the Service ends, though certain provisions of these Terms will survive.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, secure, or error-free.
10. Limitation of liability
To the maximum extent permitted by law, Waunch and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months preceding the claim.
11. Governing law
These Terms are governed by the laws of the jurisdiction in which Waunch's operating entity is registered, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer protection law.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
